1103 (Saldaņa)
This recently passed bill (now Public Resources Code Section
25402.10)
requires electric or gas utilities to maintain energy
consumption data for non-residential buildings for at least the most
recent 12 months in a format that is compatible for uploading to the
United States Environmental Protection Agency's (EPA's) Energy Star
Portfolio Manager program. Effective January 1, 2009, the utilities, upon
written or electronic authorization from the owner/operator, must upload
all of the data for a building to the Energy Star Portfolio Manager in a
manner that preserves the confidentiality of the customer. Effective
January 1, 2010 non-residential building owners must disclose to
prospective buyers and lenders the EPA's Energy Star Portfolio Manager
data and scores for a building that is being sold, leased, financed or
refinanced. This bill's provisions apply to both investor-owned and
municipal utilities.
